What is it?

The government introduced Breathing Space on 4^th of May 2021.

This is a new scheme that gives you a legal right to ask for breathing space if you are finding it difficult to pay your debts, and to give you the time you need to get debt advice.

If you are eligible, you can apply to the scheme for free through a Debt Adviser. Once you are accepted, it will stop your creditors from taking any actions against you for at least 60 days, including asking you to pay, starting any court action or sending bailiffs to your home.

If your creditors have already started court action, it may also stop them from continuing with the action for 60 days. Your creditors also have to freeze interest and most other charges during this time.

Can I apply?
To be eligible to apply, you must:

• Live in England or Wales
• Have at least one debt that qualifies
• Not have been on the Breathing Space scheme in the last 12 months
• Not have a Debt Relief Order
• Not have an Individual Voluntary Arrangement
• Not have an Interim Order
• Not be discharged as Bankrupt
